1. Acceptance of Terms
By accessing or using the BADDIES platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access or use the Service. These terms apply to all visitors, users, creators, and investors who access or use the Service.
2. Eligibility
You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We reserve the right to request proof of age at any time and to suspend or terminate your account if you are found to be under 18.
3. User Accounts
When you create an account, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. BADDIES cannot and will not be liable for any loss or damage arising from your failure to comply with this requirement.
4. Creator Content
Creators retain ownership of all content they upload to the platform. By uploading content, creators grant BADDIES a non-exclusive, worldwide, royalty-free license to display, distribute, and promote the content within the platform. Creators are solely responsible for ensuring their content complies with all applicable laws and does not infringe on any third-party rights.
5. Investments & Financial Services
The Creator Stock and Platform Index features are speculative investment products. All investments carry risk, and past performance is not indicative of future results. You acknowledge that you may lose some or all of your investment. BADDIES does not provide financial advice. You should consult with a qualified financial advisor before making any investment decisions.
6. Payments & Deposits
Deposits are accepted via cryptocurrency (BTC and ETH). The minimum deposit is €500 and the maximum deposit is €75,000. All deposits are subject to verification and compliance checks. Processing times may vary depending on network congestion and verification requirements. BADDIES reserves the right to refuse or delay any deposit at its sole discretion.
7. Prohibited Conduct
You agree not to: (a) use the Service for any illegal purpose; (b) upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable; (c) impersonate any person or entity; (d) interfere with or disrupt the Service; (e) attempt to gain unauthorized access to other users' accounts; (f) engage in any form of market manipulation regarding Creator Stock; (g) use automated means to access the Service without our express permission.
8. Termination
We may terminate or suspend your account at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive.
9. Limitation of Liability
In no event shall BADDIES, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms shall be resolved in the courts of Amsterdam, the Netherlands.
